We respect your privacy. This policy explains what personal information Supertech Asia Pacific Pty Ltd collects, why we collect it, and how you can access it or make a complaint.

1. About This Policy

This Privacy Policy explains how Supertech Asia Pacific Pty Ltd (ABN 75 684 263 830, ACN 684 263 830) ("we", "us", "our") collects, holds, uses and discloses personal information. We are the authorised Australian distributor of Supertech in-tank combustion optimisers, which are designed and manufactured in Italy.

We are a private company based in New South Wales. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). If we ever hold health information, we will also handle it in line with the Health Records and Information Privacy Act 2002 (NSW). The Privacy and Personal Information Protection Act 1998 (NSW) applies to NSW public sector agencies and does not generally apply to private businesses such as ours.

This policy applies to information collected through this website and when you deal with us by phone, email, in person or otherwise. It should be read together with our Terms & Conditions.

2. Personal Information We Collect

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. The types of personal information we may collect include:

  • your name, job title and the business or organisation you represent;
  • contact details such as your phone number, email address and postal or delivery address;
  • details of your enquiry, such as the vehicles, machinery, fleet size or fuel tank capacity you tell us about;
  • order, quote, invoice, delivery and payment records (we do not store full card numbers);
  • records of our communications with you, including emails and notes of phone calls;
  • technical information about your visit to our website, such as your IP address, browser type, device, pages viewed and the date and time of your visit.

We do not intentionally collect sensitive information (such as health information or information about your racial or ethnic origin, political opinions or religious beliefs). Please do not send us this kind of information.

3. How We Collect Personal Information

Wherever practical, we collect personal information directly from you, for example when you call or email us, request a quote or references, place an order, or meet with us.

We may also collect personal information:

  • automatically when you use our website, through cookies and similar technologies (see section 6);
  • from your employer or colleagues, if you contact us on behalf of a business;
  • from the manufacturer of Supertech products, or from resellers, installers and mechanics we work with, where that is needed to deal with your enquiry, order or warranty claim;
  • from publicly available sources such as business directories and the Australian Business Register.

If we receive personal information we did not ask for, we will decide within a reasonable time whether we could have collected it lawfully. If not, we will destroy or de-identify it where it is lawful and reasonable to do so.

4. Why We Collect, Use and Disclose It

We collect, hold, use and disclose personal information so that we can:

  • respond to your enquiries and give you product, pricing and model advice;
  • prepare quotes, process orders and arrange delivery;
  • support installation and handle warranty claims, returns and product questions;
  • send invoices, receive payment and keep financial records;
  • provide references or test reports you ask for;
  • manage our relationship with customers, resellers and suppliers;
  • operate, secure and improve our website;
  • send you information about Supertech products and offers, where you have agreed to this or where the law otherwise permits (see section 5);
  • meet our legal and regulatory obligations, including tax and record-keeping requirements.

We will only use or disclose your personal information for another purpose if you have consented, if you would reasonably expect it and the purpose is related to the reason we collected it, or if the use or disclosure is required or authorised by law.

If you do not give us the information we ask for, we may not be able to respond to your enquiry, provide a quote or supply products to you.

By providing personal information to us, you consent to us collecting, holding, using and disclosing it as described in this policy. If you give us personal information about someone else, such as a colleague or fleet driver, you confirm that you are authorised to do so and that they are aware of this policy.

5. Direct Marketing

We may send you product news, updates and offers by email, phone or post where you have asked us to or have agreed to receive them, or where the law otherwise allows. Every marketing email we send will include a simple way to unsubscribe, in line with the Spam Act 2003 (Cth).

You can ask us to stop sending you marketing at any time by using the unsubscribe link or by contacting us using the details in section 14. We will action your request promptly and will not charge you for it.

6. Cookies, Analytics and Third-Party Content

Our website uses cookies and similar technologies. Cookies are small files stored on your device that help a website work properly, remember your preferences and tell us how the site is used. Our website platform provider and any analytics tools we use may set cookies that collect information such as the pages you visit and how long you stay.

Some pages show or link to content provided by third parties, including fonts and icons loaded from external services, embedded maps from Google Maps, and videos hosted on YouTube. When you load or click on that content, the third party may collect information about your visit under its own privacy policy, which we do not control.

Most browsers let you refuse or delete cookies. If you block cookies, some parts of the website may not work as intended.

7. Who We Disclose Personal Information To

We may disclose personal information to:

  • service providers who help us run our business, such as website hosting and e-commerce platforms, email and IT providers, accounting and payment services;
  • couriers and freight companies that deliver products to you;
  • installers, mechanics and resellers involved in supplying or fitting your product;
  • the manufacturer of Supertech products, for technical support, warranty assessment and product quality purposes;
  • our professional advisers, such as accountants, auditors and lawyers;
  • government agencies, regulators and law enforcement bodies where required or authorised by law;
  • anyone else you have agreed we may disclose it to.

We require our service providers to handle personal information only for the purpose we engage them for. We do not sell, rent or trade your personal information.

8. Overseas Disclosure

Some of the organisations we disclose personal information to are located, or store information, outside Australia. In particular:

  • Supertech products are manufactured in Italy, so information needed for technical support or warranty claims may be shared with the manufacturer in Italy;
  • our website platform, email and cloud service providers may store or process information in countries including the United States, Canada, member states of the European Union and other countries where their data centres are located.

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a way that is consistent with the Australian Privacy Principles. Where you ask us to pass your details to the manufacturer, for example for a warranty or technical question, you consent to that disclosure to Italy for that purpose.

9. Storage and Security

We hold personal information in electronic records (including cloud-based systems) and, occasionally, paper records. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include password protection, access controls and using reputable service providers.

No method of sending information over the internet is completely secure, so we cannot guarantee the security of information you send to us online, including by email. To the extent permitted by law, we are not responsible for unauthorised access to personal information that occurs despite the reasonable steps we have taken, or that occurs on systems we do not control, such as third-party websites. When we no longer need personal information for any purpose permitted under the Privacy Act, and are not required by law to keep it, we take reasonable steps to destroy it or de-identify it.

If we become aware of a data breach that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme where it applies to us.

10. Accessing and Correcting Your Information

You can ask for access to the personal information we hold about you, and ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Please contact us using the details in section 14.

We will respond to your request within a reasonable time, usually within 30 days. We may need to verify your identity first. We do not charge for making a request, but we may charge a reasonable fee to cover the cost of providing access to large amounts of information. If we refuse a request, we will tell you why in writing and explain how you can complain.

11. Dealing With Us Anonymously

You can make general enquiries without giving us your name, or by using a pseudonym. However, we will need your name and contact details to provide a quote, supply products, handle a warranty claim or send you references.

12. Complaints

If you have a concern or complaint about how we have handled your personal information, please contact us first using the details in section 14. Please give us enough detail to look into the matter. We will acknowledge your complaint, investigate it and aim to respond in writing within 30 days.

If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992. For complaints about health information handled in New South Wales, you can also contact the NSW Information and Privacy Commission at www.ipc.nsw.gov.au.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in the law, our business or how we handle personal information. The updated version will be published on this page with a new "last updated" date and applies from that date. Please check this page from time to time.
